Purpose of Our Website

FindMeBuyers exists to connect homeowners who want to sell their property with cash buyers, investors, and other real estate professionals in our network. To use the service, you submit information about yourself and the home you wish to sell. FindMeBuyers and our network partners use that information to prepare and present an offer for your property. In some cases, FindMeBuyers works on your request directly; in others, we introduce you to a network partner, and we may receive a referral fee from that partner for the introduction. The service is free to you either way. You agree to provide accurate and complete information so we can deliver the service you have requested.

You agree that you alone are responsible for evaluating and bearing the risks of any dealings with FindMeBuyers, Rizzly LLC, or any buyer, investor, agent, or other party introduced to you through the service. Your decision to engage with any third party in our network is at your own discretion and risk.

Your Obligations When Submitting a Property

By completing a form on this site, you represent and agree that:

• You are at least 18 years old and otherwise legally able to enter into a binding contract;
• You are interested in selling real property located in the United States;
• You either own the property or are otherwise authorized to provide its information for the purpose of receiving an offer;
• You do not currently have an exclusive listing agreement or similar exclusive arrangement with a real estate professional that would prevent you from receiving an offer through the service;
• You agree that Rizzly LLC and FindMeBuyers may contact you about your request by phone and email at the contact information you provide and, if you opt in, by text message under the FindMeBuyers SMS Program described below;
• You agree that the buyer(s), investor(s), agent(s), or other network partner(s) matched to your request may contact you about your request by phone, email, and — where you have provided the required consent — text message. Each partner contacts you under its own consent, operates its own messaging program, is responsible for complying with applicable law, and honors its own opt-out requests. Your opt-in to the FindMeBuyers SMS Program applies only to messages from FindMeBuyers and is never transferred to any partner; and
• Consent to be contacted is not a condition of using the service or of receiving an offer.

Mobile Messaging (SMS) Terms

These terms govern the FindMeBuyers text-messaging program (the "SMS Program"), operated by Rizzly LLC.

• Program description. If you opt in, FindMeBuyers sends recurring text messages about your property request — for example, submission confirmations, offer and status updates, requests to confirm continued interest, occasional promotional updates from FindMeBuyers related to your request, and links to manage your request on findmebuyers.com.
• Opting in. You opt in by checking the SMS consent box when you submit your request, or through any other opt-in method we offer. Consent to receive text messages is not a condition of any purchase, of using the service, or of receiving an offer.
• Message frequency varies based on the status of your request.
• Message and data rates may apply. We do not charge a separate fee for text messages; your wireless carrier's standard rates apply. Carriers are not liable for delayed or undelivered messages, and delivery is subject to effective transmission by your carrier.
• Opting out. Reply STOP to any message from us to cancel at any time; we will send one final message confirming your opt-out. Reply HELP for help, or contact us at hello@findmebuyers.com.
• Privacy. Mobile information and SMS consent collected for the SMS Program are never shared with, sold to, or rented to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy at https://findmebuyers.com/policies/privacy for details.
• We may suspend, modify, or terminate the SMS Program at any time. The SMS Program is offered on an "AS IS" basis and may not be available in all areas or on all carriers.

Disclaimer of Warranties and Limitation of Liability

THIS SITE AND THE FindMeBuyers SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, Rizzly LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE, ITS SERVERS, OR ANY EMAIL OR MESSAGE SENT FROM THE SITE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, Rizzly LLC WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR THE FindMeBuyers SERVICE, OR TO YOUR DEALINGS WITH ANY BUYER, INVESTOR, AGENT, OR OTHER THIRD PARTY INTRODUCED TO YOU THROUGH THE SITE.

Governing Law

By using findmebuyers.com, you agree that the laws of the State of Wyoming, without regard to its conflict-of-laws principles, govern these Terms and any dispute that may arise between you and Rizzly LLC or its affiliates relating to the site or the service.

The site may include links to or information about third-party services such as moving companies, home improvement providers, title companies, or other businesses. We provide these links as a convenience to our users and are not responsible for the content, policies, or practices of any third-party site. Arbitration, Class-Action Waiver, and Jury Waiver

PLEASE READ THIS SECTION CAREFULLY. IT PROVIDES THAT YOU AND Rizzly LLC AGREE TO RESOLVE DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION.

a. Applicability. You and Rizzly LLC agree that all claims and disputes (whether in contract, tort, statute, or otherwise) arising out of or relating to these Terms or the FindMeBuyers service that cannot be resolved in small-claims court will be resolved by binding arbitration on an individual basis — except that either party may seek equitable relief in court for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents. Disputes about the scope, applicability, enforceability, revocability, or validity of this arbitration agreement will be decided by the arbitrator.

b. Rules. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitration will be administered by a recognized arbitration provider (such as the American Arbitration Association or JAMS) and conducted before a single neutral arbitrator in Sheridan, Wyoming, or remotely where the rules of the provider allow. Claims seeking less than $10,000 USD may be resolved through binding non-appearance arbitration at the option of the party seeking relief. Judgment on any award may be entered in any court of competent jurisdiction.

c. Fees. Each party is responsible for fees as set out in the arbitration provider's rules, except that if Rizzly LLC initiates the arbitration, Rizzly LLC will pay all filing and administrative fees.

d. Authority of the Arbitrator. The arbitrator has authority to decide their own jurisdiction and the rights and liabilities, if any, of the parties. The arbitrator may grant motions dispositive of all or part of any claim and may award any monetary or non-monetary relief available to an individual under applicable law. The arbitrator's award is final and binding.

e. JURY TRIAL WAIVER. YOU AND Rizzly LLC WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO A TRIAL BY JUDGE OR JURY. The parties instead elect to have disputes resolved by arbitration as set out in this section.

f. CLASS-ACTION WAIVER. ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Disputes regarding the interpretation, applicability, or enforceability of this class-action waiver may be resolved only by a court.

g. Small Claims. Either party may still bring an individual claim in small-claims court.

h. Opt-Out. You may opt out of this arbitration agreement by notifying us in writing within 30 days of first becoming subject to it. Your notice must include your name, mailing address, the email address you used on the site (if any), and a clear statement that you want to opt out. i. Survival. This arbitration agreement survives the termination of your relationship with Rizzly LLC.

Other Policies, Modification, and Severability

Please also review our Privacy Policy, Do Not Call Policy, and Unsubscribe Policy, all of which govern your use of the site. We may update any of these policies and these Terms at any time. If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

Acceptance

By using findmebuyers.com, you confirm that you have read, understand, and agree to be bound by these Terms and the documents incorporated by reference, and that you intend to form a legally binding contract by using the site. A printout of these Terms will constitute a "writing" under any applicable law or regulation.
